Your access and use of the Services constitute your agreement to be bound by these Terms & Conditions, which establish a legally binding relationship between you and Bookvey. If you do not agree to these Terms & Conditions, you may not access or use the Services. Bookvey may terminate services to you or discontinue offering access to the Services or any portion thereof at any time for any reason.
Supplemental terms may apply to specific services, events, activities, or promotions and will be disclosed to you in connection with the applicable services. Supplemental terms are part of these Terms & Conditions and will prevail over them in the event of a conflict concerning the relevant services.
Bookvey may modify the Terms & Conditions related to the Services from time to time. Changes will be effective upon Bookvey posting updated Terms & Conditions on this site or the applicable Service. Your continued use of the Services after such posting constitutes your consent to the modified Terms & Conditions.
Bookvey may provide information (including your contact information) to a claims processor or insurer if there is a dispute or conflict, including accidents involving you and a Third Party Provider, and such information is necessary to resolve the issue.
License Subject to your compliance with these Terms & Conditions, Bookvey grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:
(i) access and use the applications on your device solely in connection with your use of the Services; and (ii) access and use any content, information, and related materials made available through the Services for your personal, non-commercial use.
Any rights not expressly granted herein are reserved by Bookvey and its licensors.
Restrictions You may not: (i) remove any copyright, trademark, or proprietary notices from any part of the Services; (ii) reproduce, modify, distribute, or otherwise exploit the Services except as expressly permitted by Bookvey; (iii) reverse engineer, decompile, or disassemble the Services unless permitted by law; (iv) link to, mirror, or frame any part of the Services; (v) launch or run any scripts to scrape or overload the Services; (vi) attempt unauthorized access to the Services or related systems.
Ownership The Services and all related rights remain the property of Bookvey or its licensors. These Terms & Conditions do not grant you ownership rights in the Services or Bookvey trademarks.
Your Use of the Services
User Accounts To use most parts of the Services, you must register for and maintain an active personal account ("Account"). You must be 18 years or older to register. Registration requires you to provide personal information, including your name, address, phone number, and at least one valid payment method. You agree to maintain accurate, complete, and up-to-date account information.
Failure to maintain accurate information or having an invalid payment method may result in an inability to access the Services or termination of these Terms & Conditions by Bookvey. You are responsible for all activity under your Account and agree to maintain the security of your account credentials.
User Requirements and Conduct The Services are not available to individuals under 18. You may not authorize third parties to use your Account or transfer it to others. You agree to comply with all laws when using the Services and to use them only for lawful purposes. Bookvey may require proof of identity to access the Services and reserves the right to deny access if proof is not provided.
Promotional Codes Bookvey may offer promotional codes ("Promo Codes") redeemable for account credit or benefits, subject to terms set by Bookvey. Promo Codes: (i) must be used for the intended purpose and audience; (ii) cannot be transferred or made public unless allowed by Bookvey; (iii) may be revoked without liability by Bookvey; (iv) are not valid for cash; (v) may expire before use.
Bookvey reserves the right to withhold benefits if it determines the Promo Code was used fraudulently or unlawfully.
Bookvey may allow you to occasionally submit, transfer, distribute, or otherwise make available to the Services literary, audio, or visual content and data, including feedback, reviews, service requests, and competition or promotional entries ("User Content"). Any User Content provided by you remains your property. However, by providing User Content to Bookvey, you grant a worldwide, perpetual, irrevocable, transferable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works, distribute, publicly display, publicly perform, and otherwise exploit such User Content in any manner and format now known or later developed (including in connection with the Services, Bookvey’s business, and on third-party websites and services), without further notice to or consent from you and without requiring payment to you or any other person or entity.
You represent and warrant that:
You agree not to provide User Content that is defamatory, hateful, violent, obscene, unlawful, or otherwise objectionable, as determined by Bookvey at its sole discretion, whether such material is legally protected or not. Bookvey reserves the right, but is not obligated, to review, monitor, or remove User Content at its discretion and at any time for any reason, without notice to you.
You are responsible for obtaining the necessary data network access to use the Services. Your mobile network's data and messaging rates may apply if you access or use the Services from a wireless-enabled device, and you are solely responsible for such rates and charges. You are also responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and any updates thereto. Bookvey does not guarantee that the Services, or any part thereof, will function on any particular hardware or devices. Additionally, the Services may be subject to malfunctions or delays inherent to the use of the internet and electronic communications.
You understand that using the Services may result in charges for services or goods provided by a third-party provider ("Charges"). After receiving services or goods through your use of the Service, Bookvey will facilitate payment of the applicable Charges on behalf of the third-party provider as their limited payment collection agent. Payment of the Charges in this manner shall be considered the same as payment made directly by you to the third-party provider. Charges will include applicable taxes where required by law. Charges paid by you are final and non-refundable unless otherwise determined by Bookvey.
You retain the right to request lower Charges from a third-party provider for services or goods received at the time of receipt. Bookvey will accommodate any request from a third-party provider to modify the Charges for a particular service or good accordingly.
All Charges are due immediately, and payment will be facilitated by Bookvey using the preferred payment method designated in your Account. A receipt will be sent via email. If your primary payment method is expired, invalid, or otherwise unable to be charged, you agree that Bookvey may use a secondary payment method in your Account, if available.
This payment structure is intended to fully compensate the third-party provider for the services or goods provided. Except for cab transportation services requested through the Application, Bookvey does not designate any portion of your payment as a tip or gratuity to the third-party provider. Any statement by Bookvey (on its website, in the Application, or in marketing materials) that tipping is "voluntary," "not required," or "included" is not intended to suggest that Bookvey provides additional amounts beyond the agreed-upon Charges to the third-party provider.
You may not assign or transfer these Terms & Conditions in whole or in part without Bookvey’s prior written approval. You give your consent for Bookvey to assign or transfer these Terms & Conditions in whole or in part, including to:
If any provision of these Terms & Conditions is deemed unlawful, invalid, or unenforceable in whole or in part under any applicable law, such provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect. These Terms & Conditions constitute the entire agreement and understanding between the parties concerning its subject matter and supersede and replace all prior or contemporaneous agreements or undertakings regarding such subject matter.
